Consent to Terms of Use Please read these Terms of Use before using app.boostcoinz.com or any features of this site (the "Boost with Coinz Websites" or the "Service”). By using the Service, you agree to be bound by these terms of use. If you do not agree to these terms of use, please exit the Service. We reserve the right, at our discretion, to modify, add or delete portions of these terms at any time by posting updated terms of use on the Boost with Coinz Websites. There are no contracts and there are no “fees to use” the Boost with Coinz platform and technology. Use of the Coinz coins component of the service will require payments (see below under Coinz coins). We recommend that you check these terms frequently for updates. Any modifications, additions or deletions to these terms shall be effective immediately upon posting of updated terms of use. Your continued use of the Service following the posting of updated terms of use will mean that you agree to those changes. Copyrights The contents of the Boost with Coinz Web sites are protected by U.S. and international copyright laws. You may not reproduce, distribute, transmit, display, prepare derivative works, or perform any copyrighted material on the these Websites without the prior written consent of Boost Engagement LLC. Use our proprietary content requires prior written permission from Boost with Coinz or Boost Engagement LLC. Framing Boost with Coinz does not allow framing of the our various Boost with Coinz Websites. Links to Boost with Coinz Websites Boost with Coinz encourages and permits links to content on all Boost with Coinz and related Websites. However, Boost with Coinz and Boost Engagement LLC is an organization committed to the highest ethics and standards. Therefore, the linking should not (a) suggest that our products and services promotes or endorses any third party's causes, ideas, Websites, products or services, or (b) use Boost with Coinz content for inappropriate commercial purposes. We reserve the right to withdraw permission for any link. Links to Third Party Sites In some instances, Boost with Coinz has provided links to Internet sites maintained by third parties, over which Boost with Coinz has no control. LIMITATION OF LIABILITY IN NO EVENT WILL BOOST WITH Coinz, ITS DIRECTORS, OFFICERS, EMPLOYEES, MEMBERS OR VENDORS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE OR RELATING TO ANY PRODUCTS SOLD ON OR THROUGH THE SERVICE. IN NO EVENT WILL BOOST WITH Coinz, ITS DIRECTORS, OFFICERS, EMPLOYEES, MEMBERS OR VENDORS BE LIABLE FOR ANY AMOUNT IN EXCESS OF $100. Coinz You may purchase Coinz™ rewards at any time from the Coinz store. Coinz rewards must be paid by Credit Card for at time of purchase. Coinz rewards are not redeemable for cash. Unused Coinz rewards carry a 12 month expiration date from time of purchase. The value for any Coinz coins that are not activated by the expiration date is not refundable. Once Coinz Coins are activated and deposited by a participant, the points may remain in participants’ bank accounts until they are spent by the participant or refunded to the organization for a 20% service. Refunds for unused points in participant bank accounts can be made by contacting Boost with Coinz Refunds at customercare@boostcoinz.com regarding unused points which will be made in the form of a credit to purchase additional Coinz rewards. In the event that a Coinz reward purchase is lost, please contact Boost with Coinz within 30 days of the order. Boost with Coinz will make every attempt to track the order, and at our option, we will replace any Coinz rewarded that were ordered but not yet activated. Employee deposited points from Coinz Coins have no expiration if an employee user account remains active. Inactivity is defined as employee users who do not either acquire and deposit Coinz points OR redeem Coinz points over an 18 month period. Any unused values within an inactive employee user account will be subject to expiration. Monthly Fees The Boost Coinz platform has a fee to use which is $3.50 per user per month. This fee takes effect after the initial 30 day free trial. Once the 30 day trial has ended you may lose access to the platform until your payment information is entered. Fees will be charged on approximately the same day each month based on the day that you signed up for the platform. You may cancel your subscription at any time using the online option on the “billing preferences” page. Online Shopping for Rewards In the event a product available on or through the Boost with Coinz Rewards Store is listed at an incorrect points price or with incorrect information, Boost with Coinz will have the right to refuse or cancel any orders placed for product listed at the incorrect points price. Your receipt of an electronic or other form of order confirmation does not signify Boost with Coinz acceptance of your order, nor does it constitute confirmation of our offer to fulfill the product. Boost with Coinz reserves the right at any time after receipt of your order to accept or decline your order for any reason. Applicable freight and sales tax is included in the points price of the items in the Rewards Store. Applicable payroll Taxes In the case of larger award values earned by Employees. Your organization is solely responsible for determining and paying any payroll taxes that may be due and as may be required by the governing laws of your state, federal and local governments. International Users The Service is controlled, operated and intended for service within the United States. Boost with Coinz makes no representation that content, materials or products available on or through our Service are appropriate or available for use outside of the United States. If you attempt to access the Service from a location outside the United States, you are responsible for service lapses as well as compliance with applicable laws, including local laws regarding online conduct and content and U.S. export laws and regulations. Miscellaneous These terms of use, together with the Privacy Policy, represent the entire understanding of the parties regarding the use of the Boost with Coinz Websites and supersede any previous documents, correspondence, conversations, or other oral or written understanding related to these terms of use. These terms of use shall be governed by and construed under Ohio state law without regard to its choice of law rules, and, where applicable, the laws of the United States. To the extent permissible by law, any disputes under these terms of use or relating to the Service shall be litigated in the local or Federal courts located, and you hereby consent to personal jurisdiction and venue, in the state of Ohio. A modification or waiver of a part of these terms of use shall not constitute a waiver or modification of any other portion of the terms of use. If for any reason any provision of these terms of use is found unenforceable, that provision will be enforced to the maximum extent permissible, and the remainder of the terms of use will continue in full force and effect.
